About Tomkiel & Tomkiel
Tomkiel & Tomkiel, personal injury lawyers in White Plains
Tomkiel & Tomkiel is a law firm specializing in personal injury based in White Plains, New York, handling cases in Westchester County, the Bronx, and the New York metropolitan area. The firm presents itself as a three-generation team dedicated to representing injured people, with the distinctive feature that every client deals directly with Matthew Tomkiel or Stanley Tomkiel, not just with support staff or a call center.
Practice areas
The firm covers a wide spectrum of accidents and injuries. Among the matters listed on its website are construction, automobile, truck, bus, train, motorcycle, bicycle, scooter, boat, and aviation accidents; workplace accidents and New York Labor Law 240; rideshare vehicle accidents (Uber/Lyft); slip and fall accidents; premises liability; product liability; dog bites; electrocution, elevator, scaffolding, and crane injuries; and brain, spine, and knee injuries, fractures, burns, and paralysis. It also handles wrongful death cases.
Workplace injuries and workers' compensation
The firm works with highly qualified co-counsel in workers' compensation to guide injured workers when benefits are delayed, denied, or disputed. When appropriate, they pursue possible third-party claims to seek full monetary damages, including compensation for pain and suffering and total loss of income. In the construction field, the firm investigates whether New York Labor Law, sections 200 and 240, allows additional compensation for lost income, medical bills, and long-term injuries.
Case results
The website shows several results of settled cases. These include $6 million for a construction worker with permanent disability after a fall on a ramp; $5.26 million for a construction accident with catastrophic injuries that required years of litigation; $2.99 million for a train collision with serious and lasting injuries; and $2.7 million for a maintenance worker injured in a filter explosion, a case that depended on the application of the New York Labor Law. The firm warns that prior results do not guarantee a similar outcome.
Family tradition since 1979
Tomkiel & Tomkiel was founded in 1979 by Stanley Tomkiel Jr., a decorated paratrooper of the 82nd Airborne Division during World War II, who after the war practiced as a lawyer representing injured workers in Yonkers and New York City. When his son Stanley III joined the firm, he began litigating personal injury cases against responsible third parties. Stanley III served for ten years as president of the Catholic Coalition of Westchester and received recognition from Westchester County for his service to the cause of religious and civil liberties. Matthew Tomkiel, grandson of the founder, continues the family tradition and combines his work with teaching martial arts and volunteering as an adaptive snow sports instructor. Stanley Jr. passed away in 2014.
Client service approach
The firm presents itself as a practice with a personal touch, where clients speak directly with the responsible attorneys and receive constant communication throughout the process. It offers a free consultation and has a free e-booklet titled "5 important tips you must know immediately for your injury case".
